¿Existe un derecho humano a inmigrar? Una crítica del argumento de la continuidad lógica

Resumen

A través del argumento cantilever o de la continuidad lógica, Carens sostiene que las mismas razones que avalan el reconocimiento como un derecho humano de la libertad de circulación dentro de las fronteras, justifican una protección similar para la posibilidad de moverse a través de ellas. Este artículo trata de profundizar en las críticas que cuestionan de modo más serio esta tesis: la visión de la libertad de movimiento como un derecho no unido a la personalidad sino a la ciudadanía, su consideración como un medio para acceder únicamente a una gama adecuada de opciones de vida, el argumento de la prioridad de la justicia igualitaria doméstica frente a una movilidad internacional dirigida a satisfacer intereses no vitales, y la concepción del ius migrandi como un derecho de «fuga». A partir del examen de estos argumentos críticos y, con el telón de fondo de la polémica entre las concepciones ética y política de los derechos humanos, expondré mis propias conclusiones sobre la existencia o no de un derecho humano a la movilidad internacional.
