Resumen

Este trabajo acompaña la publicación del ensayo «Directrices políticas, principios y decisión judicial», un ensayo inédito de H.L.A. Hart escrito entre 1977 y 1982, en el que realiza una amplia crítica de la concepción de Ronald Dworkin sobre las «directrices políticas» en la obra (Tomarse) Los derechos en serio, y ofrece una versión ampliada de sus reflexiones sobre el razonamiento judicial por analogía y la fenomenología de la toma de decisiones judiciales. Este ensayo contribuye significativamente a nuestra comprensión del llamado «debate Hart-Dworkin», en torno al cual sigue estructurándose gran parte de la jurisprudencia anglófona contemporánea.
