Resumen

Los conceptos de dimensión y factor se originaron en sistemas pioneros de inteligencia artificial y derecho (AI&L), como HYPO y CATO, para modelar computacionalmente el razonamiento con precedentes legales. Aunque su aporte inicial fue clave para representar precedentes en IA, influenciando sistemas posteriores, su utilidad ha trascendido este campo. Este artículo explora diversas contribuciones teóricas que emplean estos conceptos, con especial énfasis en el de “factor”, más allá de su aplicación exclusiva en la teoría del precedente. Se examina la propuesta de John Horty, que lo utiliza para analizar qué elemento es vinculante en un precedente. Posteriormente, se problematizan otros enfoques de la literatura sobre “factor” y se busca clarificar el concepto recurriendo a las nociones de “caso” y “propiedades relevantes” de Alchourrón y Bulygin. Finalmente, se cuestiona el entendimiento de factor como razón en el razonamiento jurídico y se exponen las conclusiones principales del análisis.
