Resumen

El presente artículo analiza la función performativa que las leyes penales desempeñan en el juego político democrático. El objetivo es describir, con las lentes de la sociología de la performance y de medios, el modo en que los actores políticos explotan el potencial simbólico de la legislación penal a efectos de moldear significados culturales, generar identificación en la audiencia y perfilar su imagen en la cada vez más competitiva y polarizada esfera pública digital. El análisis se concreta en el estudio de dos performances legales recientes: la inclusión por parte del Partido Popular de la prisión permanente revisable (LO 1/2015); y la reforma de los delitos sexuales por la coalición progresista (LO 10/2022), a través de la llamada “Ley del sólo sí es sí”.
