Tres interpretaciones sobre la relación entre libertad, propiedad privada y redistribución en el esquema kantiano de la Doctrina del Derecho

Resumen

Este artículo analiza tres interpretaciones contemporáneas sobre la relación entre libertad, propiedad privada y redistribución en la Doctrina del Derecho de Immanuel Kant. A partir del concepto de libertad externa, se reconstruyen los fundamentos normativos de la propiedad privada y se examina si la institucionalización de esta exige políticas redistributivas. En primer lugar, se expone la interpretación liberal clásica, que entiende que la propiedad privada amplía la libertad y es formalmente compatible con la libertad de los demás, sin generar deberes redistributivos. En segundo lugar, se analiza una interpretación liberal igualitaria que se centra en los deberes de abstención que la propiedad impone a todos los no-propietarios, los que solo son justificables si el sistema de propiedad que se instituye cuenta con el consentimiento racional de todos los afectados, lo que exige redistribución. Por último, se examina la interpretación liberal republicana, que maneja una dimensión de la libertad externa como la ausencia de dominación. Según esta lectura, la institucionalización de la propiedad privada puede hacer que los que nada tienen se vean compelidos a actuar según las exigencias de los propietarios, y para evitar ello, la redistribución es una condición de posibilidad de la libertad entendida como no dominación. El artículo concluye que las distintas interpretaciones expuestas se sustentan en comprensiones divergentes —pero liberales— de la libertad, y que el esquema kantiano permite pensar diversas relaciones normativas entre propiedad y redistribución.
