La claridad pericial y el entendimiento judicial

Resumen

Cada vez más las cortes requieren de la asistencia de los peritos para determinar casos. Los peritos asisten al juez a entender los hechos relevantes. Pero este entendimiento requiere claridad expositiva y esta claridad debe ser entendida relacionalmente, lo cual le exige a la audiencia un cierto conocimiento. Por lo tanto, el juez debería poseer un cierto conocimiento si es que el perito ha de exponer claramente su opinión. Esto nos permite prescribir una continua formación judicial dado el avance e hiper-especialización de la ciencia y la tecnología. Aunque muchas veces en la literatura se menciona la necesidad de formar al juez, las razones ofrecidas terminan siendo un tanto vagas. Este artículo, entonces, ofrece un argumento basado en la necesidad de la claridad en la prueba pericial para mostrar que se requiere una capacitación científica mínima de la parte juzgadora.
